ODD Pixels LLC curates the Lucky Lava Lamps series, a digital art portfolio (NFTs) anchored on the Ethereum platform. This platform serves as a gateway for enthusiasts to engage in digital art trades. Users are solely responsible for safeguarding their private Ethereum credentials and confirming actions initiated by this platform. Transactions made on the Ethereum framework powering Lucky Lava Lamps are irreversible. Utilizing this platform and its affiliated services means you willingly accept all responsibility for transactions involving Lucky Lava Lamps digital assets.

POSSESSION PRINCIPLES AND NFT RIGHTS

When you purchase a Lucky Lava Lamp, you obtain a limited license with the rights outlined below. The Ethereum Network and its associated Smart Contracts serve as the sole arbitrators of NFT ownership; ODD Pixels LLC will not interfere with or alter any Lucky Lava Lamp ownership rights.

1. Scope of License: You may employ, reproduce, and showcase the procured digital art for:
   • Limited personal and non-profit activities.
   • Engaging within platforms that offer buying or selling options for your Lucky Lava Lamp NFT, provided cryptographic tools validate display rights.
   • Inclusion in external digital venues that incorporate your Lucky Lava Lamp, given cryptographic validations confirm genuine display rights.
   • Business-Driven Applications, like leveraging the art for commercial merchandise.
2. Exclusions from Ownership: ODD Pixels LLC retains exclusive rights to the Lucky Lava Lamp Four Leaf Clover Logo, Lucky Lava Lamp Icon, and the Lucky Lava Lamp slogan, Lucky Lava Lamp Seal and Lucky Lava Lamp Font. No rights to these trademarks, symbols, or slogans are transferred to you. Unauthorized use of these protected elements constitutes infringement and may lead to legal actions.
3. Infringement: Reproducing derivatives of NFT artworks or Lucky Lava Lamps’ slogan, logo, seal, font, and icon by a non-owner would be considered an infringement.

ODD Pixels LLC cannot guarantee uninterrupted service, immunity from hacking, or absolute security due to the inherent vulnerabilities in digital networks and blockchain technologies. By engaging with this platform, you accept these risks and absolve ODD Pixels LLC of any mental, physical, financial losses, or damages.

LIMITATION OF LIABILITY

In no event shall ODD Pixels LLC, its affiliates, directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, even if advised of the possibility of such damages. This includes, but is not limited to, loss of profits, goodwill, use, or data.

INTELLECTUAL PROPERTY RIGHTS

All digital artworks associated with Lucky Lava Lamps NFTs are copyrighted material owned by ODD Pixels LLC or its licensors. The term “Lucky Lava Lamps” and its associated logo are trademarks owned exclusively by ODD Pixels LLC. Unauthorized copying, reproduction, distribution, modification, or public display of the copyrighted digital artworks or use of the trademarked term and logo is strictly prohibited, except as explicitly stated in these Terms and Conditions.

By using the Lucky Lava Lamps platform, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions presented herein. Any use of copyrighted digital artwork beyond the scope of the license granted herein is strictly prohibited and may lead to legal actions.
